What Does a Severed Mineral Estate Mean?

In Texas, the rights to what is under a piece of land can be owned separately from the surface. When they have been split, the mineral estate belongs to one party and the surface to another. Owning the surface does not automatically mean you own what is beneath it.

This is ordinary rather than exotic. Across Tarrant, Johnson, Parker and Hood counties, which sit in the Barnett Shale, minerals were widely severed and leased over generations. Most surface owners have no idea until a title company runs the chain and it appears.

Do I Own the Minerals Under My Land?

Only a title search can tell you. Mineral interests are conveyed and reserved in deeds going back decades, sometimes split repeatedly among heirs until dozens of people hold fractional interests. Your deed alone may not settle it, and the appraisal district record does not answer it either.
